Please note the Pearl, Intimate and Everlasting Collections are available Monday- Thursday evenings. Also available on weekend mornings, and weekend early afternoons ending before 3pm. These smaller collections are not available Friday- Sunday sunset/evenings unless special permission given from owner of Capture Destiny Photos like in the case of last minute bookings weekend sunsets may become available upon request.
On all Wedding Collections: Please note as weddings book far in advance, the wedding deposit is a retainer for your date that is non-refundable from 6 months before wedding date… Additionally, please note the refund policy and editing policy that applies to all wedding collections that is given upon request and also written in great detail on the wedding contract itself.
Legal:
Editing : Delivered images are corrected at the photographer’s discretion for lighting, exposure, color temperature, saturation, contrast, tonal ranges, crops if necessary, where possible removing small distractions from the background, as well as adding ‘signature’ touches to images. Also, a fly away hair in close ups ( if not covering the face) can be fixed on the best ones by the photographer’s discretion. It is of course an outdoor environment where wind should be taken into consideration when planning hair styles.
Retouching: Specialty retouching beyond normal editing is available for purchase on the digital files themselves, and is priced per image file based on the extent of work hours requested. This specialty retouching would be items such as teeth brightening, sunburn/redness removal, face swapping where possible, specialty hand painted digital rendering of sunset added to a cloudless/ gray sky, braces removal, tattoo removal, clothing fixes ( should consider items like bra straps showing before the shoot) , and any other special requests past what was already edited and delivered on the gallery… When requested on some larger canvas wrap purchases- the specialty editing included on the canvas wrap at no additional charge includes sunburn removal, teeth whitening, tattoo removal, and clothing fixes ( to a certain extent). *These special requests have to be requested at the time the canvas order is placed before the canvas goes into production. Once the canvas is already in production specialty retouching can not take place.
Wedding Refund Information: As wedding dates book far in advance, the deposit for weddings is non-refundable if you cancel without giving six months notice. If wedding coverage is canceled within one month or less from the wedding date -client is legally responsible for paying the full remaining balance of the wedding collection they agreed upon. Changes involving lowering your wedding coverage time are allowed with six months notice, and raising wedding coverage time can be done at anytime. Also, for wedding packages that include a complimentary or discounted engagement session- the wedding deposit is non-refundable after engagement shoot has taken place. Buy paying deposit client is in agreement with following terms and conditions:
Model Release: The CLIENT hereby grants to Capture Destiny Photos photographer Noelle Willis and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Capture Destiny Photos photographer Noelle Willis and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to Capture Destiny Photos photographer Noelle Willis use of said images.
IMAGES and COPYRIGHTS: Photographs/images produced by Capture Destiny Photos photographer Noelle Willis are protected by Federal Copyright Law (all rights reserved). Upon final payment by CLIENT, CLIENT is granted limited license to use and display resulting images for personal use. Socail Media use can be done with proper tagging.Said images may not be altered or reproduced in any manner without prior written permission of Capture Destiny Photos photographer Noelle Willis. This excepting CLIENTS who receive a high resolution digital download with printing rights, who may make prints for personal use. The CLIENT must obtain written permission from Capture Destiny Photos photographer Noelle Willis prior to the CLIENT, its associates, friends or relatives publishing in magazines etc or profit selling the photographs.
LIMIT OF LIABILITY: In the unlikely event that the photographer is injured, becomes too ill, has an emergency that prevents them from photographing the event or shoot, or total equipment failure, Capture Destiny Photos and photographer Noelle Willis will make every effort to secure a replacement photographer. If a suitable replacement is not found, CLIENT agrees that responsibility and liability of Capture Destiny Photos and photographer Noelle Willis to the CLIENT is limited to the return of all deposits/payments received for the event. Capture Destiny Photos and photographer Noelle Willis takes the utmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Capture Destiny Photos and photographer Noelle Willis’ control. CLIENT agrees that Capture Destiny Photos and photographer Noelle Willis has responsibility and liability is limited to the return of all deposits/payments received for the event. Liability can not and will not exceed the deposits/payments that Capture Destiny Photos and photographer Noelle Willis received for the event. CLIENT further agrees that the limit of liability for a partial loss of originals before delivery to CLIENT shall be a prorated amount of the images lost based on the estimated percentage of the total number of original images. Images are stored for backup purposes for 1 calendar month after the images are delivered. If the client fails to make duplicate copies or download all images to their own personal device off of the digital delivery, or disc or usb as directed-and the delivery device stops working- Capture Destiny Photos and photographer Noelle Willis is not responsible for the loss of all images. CLIENT understands it is their responsible to create their own back up storage of images. Capture Destiny Photos and photographer Noelle Willis are not responsible for any injuries or accidents resulting in medical expenses or loss of property due to CLIENT or any shoot participants or other attendees tripping over Capture Destiny Photos and photographer Noelle Willis equipment or any other type of accident or injury resulting from the photo session. All accidents resulting in loss of property or medical expenses should be covered personally by the CLIENT or by the shoot participant and by signing below CLIENT and all guests and participants attending the shoot release Capture Destiny Photos and photographer Noelle Willis from any and all responsibility of all damages, medical expenses, and property loss caused by any accident stemming from the photo session or negligence due to the fault in any way of Capture Destiny Photos and photographer Noelle Willis.
